Thursday, July 25, 2019 Delays, Inconsistencies Create Stress for Injured Workers Submission on the 2019 Ontario Workplace Safety and Insurance Board Review Policy Briefs The Ontario government has undertaken a review of the Workplace Safety and Insurance Board (WSIB) and CLAC has drafted a submission outlining where it sees problems in the system, as well as possible solutions to address these challenges. The WSIB system is an important component of the health and safety support system for workers, and a review is certainly warranted. The single greatest issue in the WSIB system today is delays in processing claims. CLAC wishes to point out clearly where these delays are experienced most acutely, and recommend what is needed to enhance the system. Problem areas include Lack of direct communication with case managers causes delays Delays in first level and tribunal appeals Inconsistencies and improper evaluations in the return to work process Delays in the implementation of awards Other challenges include incomplete information from physicians via the Functional Abilities Form, lack of coverage for residential care workers, and the fact that nothing in the Workplace Safety and Insurance Act makes it clear that a union has a duty to fairly represent an injured worker who may not access the office of the worker advisor.
